Can I protect my intellectual property?

 

China's entry into the WTO greatly improved the letter of Intellectual Property (IP) law, but did almost nothing to change how those laws were enforced.  Piracy, fraud and counterfeiting are all still endemic problems in China and you can expect little or no help from the local authorities.

 

As with so many things in China, relationships are part of the solution to the problem.  We work with trusted companies that are motivated to maintain a good working relationship with us in order to gain future orders and maintain their local reputation.  This decreases the chances of an IP problem, but it is not sufficient by itself. 

 

Depending on the project, we employ a combination of additional techniques to help safeguard our client's intellectual property including:

  • Embedded source inspection at the factory

  • Avoiding concentration of IP by having multiple, geographically dispersed factories

  • Withholding key process parameters from manufacturing partners

  • Avoiding revealing all process steps to a single Chinese partner

  • Controlling raw material supply - so we know how many they made

  • Securing physical and electronic access to key IP assets

If IP issues do arise, our team in China can often help reach a resolution before it becomes a major problem.  There is really no substitute for being physically present.
